O R D E R
This cause came on May 19, 1997, to be heard on plaintiff's application pursuant to Va. Code § 58.1-1825 for correction of erroneous tax assessments.And the court having considered the evidence and arguments presented by the parties, and for the reasons stated in the letter opinion dated this date, it is
ORDERED that plaintiff's application is granted, that the assessments for tax years 1990, 1991, 1992 and 1993 are declared to be erroneous, and that the defendant shall refund to the plaintiff the taxes collected pursuant to such assessments, with interest as provided in Va. Code § 58.1-1833, defendant’s objections being noted. The parties shall bear their own costs.
A copy of this order was mailed this day to counsel for the parties. The clerk is directed to certify a copy of this order to the Tax Commissioner pursuant to Va. Code § 58.1-1826.
